"Republican legal theories" are Republican principles that govern America and it is spelled out in our constitution. It isn't new or complicated. It's just that lawyers & politicans don't want to adhere to the rules consistenly. Republican isn't refering to Republican Political party either. Republican, is a form of democracy.
The United States has improved the human conditions for itself and others around the world, using these principles. Lawyers & politicans must know these rules for two reasons; Western liberal democracy in American was established in 1787 with the ratifing of America's Constitution. Second, it is our elected way to run our goverenemt as the constitution mandates. Great empires only collapse from within because its leaders, with little backbone, allow it to fail. Notably examples are the past failures of the Greek and Roman empires. If adults don't have the inquisitiveness to know our own history, we'll lose it. Like people who hit their head, then developed amnesia, they forget who they are. Nations develope amnesia and cease to be what they where - good by America. Hundreds of years from now students studing history, in some other parts of the world will ask themselves; why didn't The United States of America just continue what they started out doing? Answer, America distroyed itself because it developed amnesia.
Public officals must uphold fundamental requirements of government;
* The rule of law is essential. We shouldn't write executive orders to get around laws we don't like. If we don't like the laws we can change them. Immigrants coming into the U.S. have legal ways to do so. Citizens have the right to vote, not everyone, just citizens. Think how our system can be corrupted in such a short time. Politicans not following the rule of law for social greed are corrupted. The big disappointment is those that actually believe they are doing the right thing by not following a law. Such a lack of integrity by part of the public and public officals, is all it takes for a nation to collapse. We are always one generation away from failure.
* Judges must respect the rule of law in their judgements. The Supreme Court is the supreme judicial body in America. But people are people, at times the members of the court aren't supreme in judgments. but we have to live their verdicts.
* The legislative bodies, the House & Senate, past the laws the judges are trusted to uphold.
The seperation of powers is the key to America's political system. Each branch of government has it's own responsibility.
Republicanism requires democracy and liberalism does not. Republican liberty requires that no person be governed by another person's simple will or passion.
The America Trinity is printed on every American coin -" Liberty, In God We Trust and E plurbus Unum" (Out of Many One) . Are these; actions, goals or just a fanasty to you? Such a simple system, yet there are those who still lack the integrity to keep these Republican Democratic principles alive. 5/13/2019
This is the last of the boring stuff, but its the foundation. Rome began as a small village with few inhabitants, but with extensive rights for all citizens. As the Roman Empire grew, the rights of Roman citizens diminished. Until nearly everyone in the Mediterranean world enjoyed Roman citizenship. The common good gave way to the emperor's whims, concluding that only small republics could work. Rome's fate, and that of every other nation since has confirmed unelected rulers run gonernments in their own interests.
